  • Spouse: Must be legally married to you, of any sex, and at least 18 years old.
  • Common-Law Partner: Not legally married to you, can be of any sex, at least 18 years old, and has cohabited with you continuously for at least 12 months in a conjugal relationship, with any separations being short and temporary.
  • Conjugal Partner: Not legally married or in a common-law relationship with you, can be of any sex, at least 18 years old, in a conjugal relationship with you for at least 1 year, resides outside Canada, and is unable to cohabit with or marry you due to significant legal and immigration barriers, such as marital status, sexual orientation, or persecution based on religious or social grounds.

Eligibility Criteria for Sponsoring in Canada

  • Must be at least 18 years old.
  • Must be a Canadian citizen, permanent resident, or registered under the Canadian Indian Act.
  • Canadian citizens living abroad must intend to return to Canada with their sponsored family members.
  • Permanent residents residing outside Canada are ineligible to sponsor.
  • Must demonstrate financial self-sufficiency and not be reliant on social assistance, except for disability reasons.

  • No Reliance on Social Assistance: The sponsor ensures that the sponsored spouse or partner does not need to rely on social assistance. Should the sponsored person receive such assistance, the sponsor is obligated to repay the government.
  • Agreement with Province or Territory: The sponsor agrees that the sponsored person will reside in a Canadian province or territory where sponsorship eligibility applies. For sponsors residing in Quebec, additional compliance with Quebec’s sponsorship requirements is necessary.
